These Terms and Conditions (hereinafter, the “Terms and Conditions”) regulate access and use of the Website www.oliviamareque.com (hereinafter, the “Website”) owned by REVIERE STUDIOS SL (hereinafter, “OLIVIA MAREQUE”), with C.I.F. B70904685, and with address at C/ENRIQUE PIRE GARCIA Nº35 BAJO 03204 ELCHE (ALICANTE), as well as the conditions of sale of the products offered by OLIVIA MAREQUE on its Website.

As a user of OLIVIA MAREQUE, you must fully accept these conditions of use, as well as the different modifications and/or additional legal texts that OLIVIA MAREQUE may include in the future.

2. Acceptance of the Terms and Conditions of Use and access to the Website

By using the services of the Website, the user accepts these Terms and Conditions, which define the rights and obligations of the OLIVIA MAREQUE Website. User registration will not be required to access the Website. However, in order to purchase any of the products offered by OLIVIA MAREQUE, user registration and prior verification and acceptance by OLIVIA MAREQUE will be required, in accordance with these conditions before formalizing the corresponding order.

This Website has been developed by OLIVIA MAREQUE with the purpose of offering users the purchase of bags and accessories, among others, (hereinafter, the “Products”). 

At the time of choosing the OLIVIA MAREQUE Products, the user must choose the corresponding Product that is available on the Website. The purpose of these general conditions is to regulate the sale of these Products to users.

5. User Data and conduct on the Website

In order to purchase the Products offered through the Website, it is not necessary to register as a User.

However, and when ordering the products, the User must check that their data is correct and complete and inform OLIVIA MAREQUE when there is any variation and/or modification in the information provided in the purchase process.

Use of the Website for fraudulent purposes, or related to criminal offenses or illicit activities of any kind, is not permitted.

It is also prohibited to send, use or reuse material that is unlawful, offensive, abusive, indecent, defamatory, obscene or threatening of any kind, or that violates copyright, trademark or confidentiality, privacy or any other right, or is otherwise libelous or objectionable to third parties, or whose content contains computer viruses, political propaganda, content advertising, chain mail, mass mailing or any other type of “spam” and, in general, any type of unnecessary annoyance or inconvenience.

The User undertakes to make lawful, diligent, honest and correct use of any information or content they have access to through the Website, and all of this under the principles of good faith and with respect at all times for current legislation.

Likewise, the User undertakes not to cause maliciously or intentionally any damage or harm that may impair, alter the Website itself, as well as not introduce or spread computer viruses that may cause unauthorized alterations to the contents or systems that make up the Website.

In the event that OLIVIA MAREQUE detects any anomaly or there are justified reasons that a User is carrying out any fraudulent acts that contravene good faith and these Terms and Conditions, OLIVIA MAREQUE reserves the right to terminate said User, including all those Users who have benefited directly or indirectly from this type of actions, and may also exercise all legal actions that may apply. In this sense, OLIVIA MAREQUE declares that it has enabled the appropriate mechanisms to detect any possible fraudulent, anomalous or malicious action that seeks to alter the general conditions of use of the account by users.

6. Orders and conditions of sale

To make a purchase, the User must be over 18 years of age, or, otherwise, they must have previously obtained the authorization of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the Website by minors in their care.

OLIVIA MAREQUE places orders to the Iberian Peninsula (including the Balearic Islands), to the territory of the European Union depending on the website the user is visiting.

In no case will OLIVIA MAREQUE intentionally put more units on sale than it has available. In the event that the Product is not available after the order has been placed, the User will be informed by email or telephone, offering them the possibility of delaying delivery or replacing the Product with a similar one, or failing that, refund the amount paid.

7. Prices and payment method

All prices of the Products indicated through the Website are expressed in Euros and include VAT and other taxes that may apply. They do not include taxes to which they are subject in countries or territories outside the European Union.

The User must pay the amount corresponding to their order by credit or debit card (Visa, Mastercard,).

Once the order has been formalized, that is, after acceptance of these Terms and Conditions and payment of the order, OLIVIA MAREQUE will always send an email to the User confirming the details of the purchase made and the corresponding invoice or receipt.

Users are guaranteed that the payment process is carried out with absolute security, in accordance with the required security protocols and services.

The prices of the Products that appear on the Website may be subject to variations. OLIVIA MAREQUE reserves the right to change prices without prior notice. 

If OLIVIA MAREQUE identifies a manifest error in the price of the Products, it will inform the User and they will have the option to reconfirm their order at the correct price or, failing that, cancel it. At OLIVIA MAREQUE, therefore, we make the usual customer service channels available to the User so that they can choose to reconfirm the order at the correct price that we transfer to them or, where appropriate, proceed to cancel it.

Likewise, the User must notify OLIVIA MAREQUE of any improper or fraudulent charge on the card used for purchases, through the “contact” section of the Website, or by sending an email to info@oliviamareque.com in the shortest period of time possible so that OLIVIA MAREQUE can carry out the appropriate procedures.

8. Information about the Products and services of OLIVIA MAREQUE

The data included on the Website in the descriptions of the Products is based on the information provided by the Suppliers.

It is possible that the Products sent by OLIVIA MAREQUE may differ from the photographs that appear in the sheets of the Products that the User purchases, both in design and color. If this happens, you can contact us directly at the email info@oliviamareque.com.

9. Deadlines, place of delivery and loss

9.1. Product Delivery

OLIVIA MAREQUE undertakes to deliver the Product in perfect condition to the address indicated by the User. In order to optimize delivery, we thank the User for indicating an address to which the order can be delivered within normal business hours. OLIVIA MAREQUE delivers its Products from Monday to Friday.

To avoid delivery incidents (wrong addresses, inability to find someone at home, etc.), it is essential to correctly complete the corresponding form, and it is mandatory to fill in the box relating to the contact telephone number (it is recommended that it be a mobile phone).

OLIVIA MAREQUE will not be responsible for errors caused in delivery when the delivery address entered by the User in the order form does not correspond to reality, is false or has been omitted.

Without prejudice to the foregoing, OLIVIA MAREQUE undertakes to adopt those measures within its reach, so that the delivery of orders can be made within the agreed time, and if not, as soon as possible, to the satisfaction of the recipient.

9.2. Delivery and notification period

The estimated times for the preparation of orders placed on the Website are 24-48 hours depending on the time they are received in the OLIVIA MAREQUE systems. The time needed by the Transport Agency to deliver to the address stated in the order (transit time) must be added to the preparation time.

Notwithstanding the above, Users are informed that the stipulated delivery dates will be estimates.

OLIVIA MAREQUE will not make deliveries or shipments on Saturdays and Sundays or on national or community holidays.

In the event that the User cannot be located at his or her home, the courier company will try to leave notice as possible depending on the type of home, etc. indicating where the order is and how to collect it.

OLIVIA MAREQUE will try to deliver orders in a single shipment whenever possible. OLIVIA MAREQUE reserves the right to split the delivery of orders if circumstances demand it, for example: if part of an order is delayed or is not available. In the event that OLIVIA MAREQUE has to split an order, it will notify the User of its intention to do so, sending a message to the email address that the User provided when placing the order. In this case OLIVIA MAREQUE will not charge any additional shipping costs.

For users outside of Spain who would like to purchase any of the Products that appear on the Website, you must consult the rates and countries we serve at the email address info@oliviamareque.com. 

9.3. Diligence in delivery

The User must check the good condition of the package with the carrier that delivers the requested Product. It is important to have photos for evaluation and subsequent claim to the transport companies.

If the User detects any anomaly in the Product, they must indicate it on the delivery note and in turn notify OLIVIA MAREQUE by email to the following address: info@oliviamareque.com 

OLIVIA MAREQUE informs the User that the Transport Agency has contracted insurance that will cover the risks of loss, damage or impairment of the Product.

10. Returns and right of withdrawal

10.1. Returns due to manufacturing defects.

All Products offered through the website will be completely original. Likewise, all of them will have a warranty period of 3 years from receipt of the Product. Said guarantee will be provided by the Supplier.

Taking into consideration that the website sells Products that have a life/use period typically less than three years, it will be understood, unless proven otherwise, that the Products are in accordance with the contract as long as they meet all the requirements expressed below: a) They conform to the description made by the seller and possess the qualities of the Product that the seller has presented to the user in the form of a sample or model. b) Are suitable for the uses to which Products of the same type are ordinarily intended. c) They present the usual quality and performance of a Product of the same type that the consumer and user can reasonably expect, taking into account the nature of the Product.

OLIVIA MAREQUE customers benefit from the guarantee given by the different manufacturers of each of the items. Defects or damage due to incorrect use or handling of the material or wear and tear caused by its use are not included in this warranty. Decreases in the functionality of the articles, due to limitations in their design, are also excluded from the coverage of this guarantee.

During the warranty period, the User may return to OLIVIA MAREQUE, free of charge, any Product that has a manufacturing defect. To formalize the return, the User must contact OLIVIA MAREQUE through the email address info@oliviamareque.comindicando, indicating the Product or Products to be returned and a detailed list of the defects found therein. Once said communication is received, the OLIVIA MAREQUE customer service team will process the collection of the defective Product for shipment to its warehouses, at no cost to the User.

In the event of a defective Product, OLIVIA MAREQUE will proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, procedures that will be free of charge for the customer. The client must inform the seller of the lack of conformity within three years of becoming aware of it.

10.2. Withdrawal, Exchanges or Returns.

In the event that the User is not satisfied with the Products received in their order, the User will have a period of thirty (30) calendar days to make changes or returns, without any penalty and without the need to indicate the reasons, OLIVIA MAREQUE will also be responsible for the direct cost of the change or return of the order only in the first return of the order, not the costs of successive returns of the same order if any.

In any case, the Products must meet the following requirements:

  • The Products have not been used or washed in any way;
  • The Product is in good condition and, if possible, with the original packaging;

To formalize the exchange or return, OLIVIA MAREQUE below proposes a model withdrawal form:

I hereby inform you that I withdraw from our contract of sale of the following goods:

  • Order received on (day/month/year)
  • Name of consumer and user
  • Address of consumer and user
  • Signature of the consumer and user (only if this form is submitted on paper)
  • Date”

Each Product to be returned must be in perfect condition, unused and with all its labels and original accessory elements that came with it. If the User does not proceed in this way, OLIVIA MAREQUE reserves the right to deny the return.

Once the Product has been received, OLIVIA MAREQUE will proceed to return the corresponding amounts paid as soon as possible and, in any case, within fourteen (14) days following receipt of the Product in the OLIVIA MAREQUE warehouses, in the same way in which the original payment was made.

11. Conditions applicable to promotional codes

When used in accordance with its terms and conditions, a promotional code allows you to obtain a single discount on the purchase of a single Product or on the order of more than one Product during the period of time indicated in said promotional code.
Promotional codes are personal and non-transferable and can only be used for online purchases through the Website. The User who owns a promotional code may not sell, change or assign it to anyone. It is not permitted to disclose said promotional code by any method through websites or other means of public offer, gift, sale or exchange. It is not allowed to use promotional codes for commercial purposes.
Promotional codes are linked to the OLIVIA MAREQUE brand. The User may not use promotional codes with any other brand, company or name, nor is their use permitted in an illegal, improper or disrespectful manner, or in any other way that damages the reputation of OLIVIA MAREQUE.
A promotional code can only be used to apply a discount on a specific Product and for a single order. It is not possible to combine promotional codes with each other or with any other special offer or promotion.
Promotional codes cannot be exchanged for money.
Without affecting any other rights that OLIVIA MAREQUE may have, OLIVIA MAREQUE has the right to immediately cancel a promotional code if it suspects that it has been used or is likely to be used in violation of any of the conditions set out above. or in any other incorrect way, whenever OLIVIA MAREQUE deems it appropriate.

13. Intellectual and industrial property
